Medical Service Brokerage Agreement
1. PARTIES
This Medical Service Brokerage Agreement (“Agreement”) is made effective as of the date of signature by and between Surgero Sağlık Turizm Limited Şirketi (“Surgero”) and the undersigned Client. By accepting this Agreement, the Client acknowledges understanding and agreeing to comply with these terms. Surgero reserves the right to amend this Agreement as necessary.
2. DEFINITIONS
- Service Provider: Refers to the individuals and/or entities providing necessary services such as medical, hospital, accommodation, and transportation to facilitate health tourism services for the Client. Surgero acts as the intermediary, not the direct Service Provider.
- Client: The individual seeking to access Service Providers and Hospitals for healthcare services in Turkey through Surgero.
- Hospital: A healthcare facility to which Clients are directed by the Service Provider, capable of providing the requested health service.
- Hotel: The accommodation facility where Clients stay as part of the services under this Agreement.
- Transportation: Refers to transport services (including airport transfers and in-city transport) arranged by the Service Provider for the Client as part of the health tourism service package.
3. SUBJECT OF THE AGREEMENT
This agreement outlines the terms under which Surgero, acting as an intermediary, arranges for medical tourism services in Turkey, including but not limited to medical, hospital, accommodation, travel, and transportation services, and details the rights and obligations of both parties.
4. AGREEMENT PRICE AND METHOD OF PAYMENT
The Client agrees to a prepayment of 15% to 25% of the total service cost, non-refundable, to secure service arrangements. Full payment is required prior to the operation date, with specific details on payment methods and conditions outlined within.
5. RIGHTS AND OBLIGATIONS OF SURGERO
Surgero will act solely as an intermediary, directing the Client to appropriate clinics and medical professionals. Surgero is not liable for the direct medical services received. Any dissatisfaction with medical services must be addressed with the actual Service Providers, not Surgero.
6. RIGHTS AND OBLIGATIONS OF THE CLIENT
The Client is responsible for providing accurate medical and personal information, making timely payments, and understanding that Surgero acts as an intermediary in arranging services. The Client is advised to insure against potential risks associated with medical treatment and travel.
7. CANCELLATION AND ASSIGNMENT OF THE AGREEMENT
Details regarding the cancellation policy, including conditions under which cancellations are permitted and the financial implications thereof, are specified. Surgero retains the right to amend service arrangements as necessary.
8. CONFIDENTIALITY AGREEMENT
Both Surgero and the Client commit to maintaining the confidentiality of shared information in accordance with applicable data protection laws. Direct communication or negotiation between the Client and Service Providers outside of Surgero's intermediation is prohibited.
9. OTHER TERMS
Additional terms cover various logistical and operational aspects of the services provided, including accommodations, transportation, and responsibilities for personal belongings and additional expenses.
10. APPLICABLE LAW AND JURISDICTION
This Agreement shall be governed by Turkish law, with Istanbul Courts and Execution Offices holding jurisdiction over disputes.
